Terms of Service

1. Acceptance of Terms

By creating an account or using StormTrace, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use StormTrace.

2. Description of Service

StormTrace is a SaaS platform that provides storm event data, property lead generation, and CRM tools for roofing contractors, public adjusters, restoration companies, and insurance professionals. StormTrace aggregates data from NOAA, the National Weather Service, and other public and commercial sources.

3. Subscription and Billing

StormTrace offers paid subscription plans at the prices listed on stormtrace.app/pricing. Subscriptions are billed monthly or annually and renew automatically unless cancelled.

Payments on iOS are processed by Apple through in-app purchase. Web payments are processed by Stripe. StormTrace does not store your payment card information.

Cancellation: You may cancel your subscription at any time through the App Store (iOS) or your account settings (web). Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

Refunds: All subscription fees are non-refundable except as required by applicable law or Apple's standard refund policy for App Store purchases. One-time purchases (property report credits, bulk contact packs) are non-refundable once the data has been delivered.

4. Storm Data Disclaimer

Storm data provided by StormTrace is sourced from NOAA, the National Weather Service, NCEI, and other third-party providers and is provided "AS IS" without warranty of any kind. StormTrace makes no representations regarding the accuracy, completeness, or fitness for a particular purpose of any storm data.

Storm data is historical and informational only. StormTrace does not guarantee that any particular property sustained damage from a reported storm event. Users are solely responsible for verifying storm damage claims through independent inspection. StormTrace is not liable for any business decisions made based on storm data provided through the platform.

Storm reports generated by StormTrace have not been reviewed by a licensed meteorologist and do not constitute a meteorologist-reviewed weather opinion or expert certification.

5. Property Data and Contact Information

StormTrace provides property ownership and contact information ("Contact Data") sourced from BatchData and other commercial data providers. By using StormTrace's lead generation features, you agree to the following:

TCPA Compliance (Required)

You are solely responsible for complying with the Telephone Consumer Protection Act (TCPA), the National Do Not Call Registry, and all applicable federal and state telemarketing laws before contacting any individual whose information appears in StormTrace. StormTrace provides contact data as-is and does not screen numbers against the DNC Registry. You must perform your own DNC screening before initiating calls or texts. You agree to indemnify and hold harmless StormTrace from any claims, damages, fines, or legal fees arising from your violation of the TCPA or any telemarketing law.

FCRA Disclaimer (Required)

StormTrace is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA). The data provided through StormTrace may not be used to determine eligibility for credit, insurance, employment, housing, or any other purpose governed by the FCRA.

CCPA Compliance

If you operate in California or contact California residents, you are responsible for complying with the California Consumer Privacy Act (CCPA/CPRA), including honoring any "Do Not Sell or Share" requests from California residents.

Permitted Use

Contact Data obtained through StormTrace may only be used for the purpose of contacting property owners regarding storm damage restoration, roofing, or related services. Any other use is strictly prohibited.

StormTrace and its original content, features, and functionality are owned by StormTrace and are protected by intellectual property laws. You may not copy, modify, or distribute any part of StormTrace without our written permission.

8. Limitation of Liability

To the maximum extent permitted by applicable law, StormTrace's total liability to you for any claims arising from these Terms or your use of the service shall not exceed the amount you paid to StormTrace in the twelve (12) months preceding the claim.

StormTrace is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless StormTrace and its officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of StormTrace; (b) your violation of these Terms; (c) your violation of any applicable law including the TCPA; or (d) your use of Contact Data obtained through StormTrace.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Hillsborough County, Florida.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of StormTrace after the effective date constitutes acceptance of the updated Terms.
